All materials, software, designs, and deliverables provided by SmartSITT remain our intellectual property unless explicitly stated otherwise in a separate written agreement. Clients may not copy, distribute, or modify our proprietary work without express written consent.
Custom Development: For custom software projects, ownership terms will be defined in the project agreement. Typically, clients receive a perpetual license while SmartSITT retains IP rights.

Maximum Liability: Our total liability is limited to the fees paid for the specific service in question, up to a maximum of the previous 12 months of fees.

Payment Due: Payment is due within 30 days of invoice date.
Late Payment: Late payments incur a 2% monthly interest charge.
Suspension: Services may be suspended for accounts more than 60 days overdue.

Upon Termination: Clients will receive all deliverables completed to date. Outstanding fees remain payable. Data will be returned or securely destroyed per your written request.

Neither party shall be liable for failure to perform due to circumstances beyond reasonable control, including natural disasters, war, terrorism, strikes, or government actions.
We reserve the right to update these Terms of Service. Clients will be notified of material changes via email or through our website. Continued use of services constitutes acceptance of updated terms.
Governing Law: These terms are governed by the laws of Libya.
Jurisdiction: Disputes will be resolved in the courts of Tripoli, Libya.
Arbitration: Parties agree to attempt mediation before litigation.
These Terms of Service, together with any signed service agreements and our Privacy Policy, constitute the entire agreement between SmartSITT and the client.
